XKYLAN LLC ("XKYLAN," "we," "us," or "our") provides AI and automation consulting services. This policy explains how we collect, use, disclose, and retain personal information when you visit xkylan.com, submit a contact or waitlist form, or otherwise communicate with us.

Information You Provide

When you contact us or join our waitlist, we collect information you choose to provide, including:

  • First and last name
  • Email address
  • Business name and industry
  • A description of your business needs
  • Other information you include in your message

Information Collected Automatically

When you use the site, we and our service providers may automatically collect:

  • IP address and approximate location
  • Browser, device, operating system, and user-agent information
  • Pages visited, site interactions, and performance information
  • Referring page or website
  • Campaign parameters, including UTM values
  • Advertising identifiers, click references, and conversion events related to a ChatGPT ad
  • Security and bot-detection signals processed by Cloudflare Turnstile

Cookies and Similar Technologies

We use browser storage and similar technologies for site preferences, campaign attribution, analytics, security, and advertising measurement. For example, campaign parameters may be kept in session storage so they remain available as you move through the site.

If you arrive after clicking a ChatGPT ad, the OpenAI Pixel may capture the OpenAI click reference, called oppref, from the landing-page URL and store it in a first-party cookie. This can associate a later conversion event with the eligible ad click. Browser or device controls may limit cookies or local storage, but doing so may affect site preferences or measurement.

Vercel states that its Web Analytics product does not use third-party cookies and uses aggregated data by default. Learn more in Vercel's Web Analytics privacy documentation.

How We Use Information

We use the information we collect to:

  • Respond to inquiries and provide service-related communications
  • Manage consulting inquiries and our waitlist
  • Understand client needs and improve our services
  • Operate, secure, troubleshoot, and improve the site
  • Detect spam, fraud, and abuse
  • Measure whether a ChatGPT ad led to a completed contact request
  • Comply with law and protect our rights

The website does not submit contact-form field values to an AI model for automated decision-making.

How We Disclose Information

We disclose information to service providers and other parties as needed for the purposes described in this policy, including:

  • Cloudflare: Database hosting, content delivery, security, and Turnstile bot detection
  • Vercel: Website hosting, operational logs, Web Analytics, and Speed Insights
  • Resend: Delivery of contact notifications and confirmation emails
  • OpenAI: ChatGPT Ads conversion measurement, as described below
  • Advisers and authorities: Professional advisers, regulators, law enforcement, or other parties when reasonably necessary to comply with law or protect rights and safety
  • Business transactions: A buyer, successor, or other participant in a merger, financing, reorganization, or sale of all or part of the business

We do not sell or rent personal information for money.

OpenAI Ads Conversion Measurement

We load the OpenAI Pixel on pages of this site. It may receive page and conversion events, campaign or click identifiers, and technical request information. We use this information to measure and optimize ChatGPT advertising.

As of this policy's effective date, automatic advanced matching is disabled. The pixel is not configured to send contact form values or hashed contact information. If we enable automatic advanced matching or begin sending additional personal information, we will update this policy and implement any legally required choice or consent mechanism first.

OpenAI processes conversion data under its Conversion Terms and Ad Tools Data Processing Addendum. Except for restricted processing described in that addendum, XKYLAN and OpenAI act as independent controllers for personal data processed through the conversion tools.

Data Retention and Security

We retain information for as long as reasonably necessary for the purposes described in this policy, including responding to inquiries, maintaining business records, preventing abuse, resolving disputes, and complying with law. Retention periods vary by category and system. We may retain information longer where required or permitted by law, and we may delete or de-identify it when it is no longer needed.

We use reasonable administrative, technical, and organizational safeguards designed to protect personal information. No security measure or transmission method can guarantee absolute security.

Your Privacy Choices

Depending on where you live and which privacy laws apply, you may have rights to request access, correction, deletion, or a portable copy of personal information, or to object to or opt out of certain processing. These rights may be subject to verification and legal exceptions.

To make a request, email contact@xkylan.com. We will respond within the period required by applicable law. You may also unsubscribe from marketing emails by using the unsubscribe instructions in the message, when provided.

California Privacy Disclosures

Browser Privacy Signals and Other-Party Collection

We do not currently respond to browser Do Not Track signals because there is no universally accepted standard for those signals. If XKYLAN becomes legally required to honor a browser-based opt-out preference signal, such as Global Privacy Control, we will implement and describe the applicable process.

OpenAI may collect information about activity on this site over time and associate it with eligible ChatGPT ad interactions for conversion measurement. Vercel and Cloudflare also collect limited site activity or technical information to provide the analytics, performance, hosting, and security services described in this policy. Their processing is governed by their own notices and our agreements with them.

California Consumer Privacy Act

If the California Consumer Privacy Act applies to XKYLAN and your information, California residents may have rights to know, access, correct, delete, or obtain a portable copy of personal information; to opt out of sale or sharing; to limit certain uses of sensitive personal information; and not to receive discriminatory treatment for exercising privacy rights.

We do not sell personal information for money. To submit a request or ask whether an opt-out right applies to our advertising measurement, email contact@xkylan.com. We may need to verify your identity or an authorized agent's authority before completing a request.

International Processing

Our providers may process information in the United States and other countries, where privacy laws may differ from those where you live. Where applicable law requires a transfer mechanism, we rely on contractual or other legally recognized safeguards.

Children's Privacy

Our site and services are not directed to children under 16, and we do not knowingly collect personal information from children under 16. If you believe a child has provided personal information, please contact us so we can evaluate and delete it as appropriate.

Changes to This Policy

We may update this policy to reflect changes in our practices or applicable law. We will post the revised policy on this page and update the effective date. If a change is material, we will provide any additional notice required by applicable law.
